The practice is able to quickly and efficiently set up corporate entities, trusts and other similar structures for local and international clients, administered by the above companies. Through its network of international contacts the practice can arrange incorporations in other international financial centres throughout the world, recognising that sometimes it is beneficial for its clients to have multi-jurisdiction structures and to have the availability of excellent professional advice in these other jurisdictions.

More complicated structures such as protected cell companies might also be incorporated if required. Trusts have developed in Guernsey at a relatively fast pace over the past decade. In 1989 the Trusts (Guernsey) Law came into force (as amended in 1990) and these laws are totally different from the U.K. Trustee Act of 1925.

The Guernsey law has developed a more practical and workable approach to trust law. It is for this reason that Guernsey trusts are so highly regarded among other offshore financial centres. The Guernsey law of trusts permits revocable trusts and has been amended to deal with forced heirships.

The Guernsey discretionary trust is a useful vehicle permitting great flexibility in the management of any Trust Fund whilst distancing the settlor from the assets of the Fund. Of course a letter of wishes might be used to indicate to the Trustees how it is felt their discretion might be exercised. It should be understood however this letter is not binding on the Trustees who are at all times bound by the Trust Deed.
